Terms of Use
The agreement between you and the operator of Astro Clock AI. It explains what this service is, what it is emphatically not, and what each of us is responsible for.
Effective on signature - this draft is not yet in force
1. Acceptance and who may use this service
Draft for review
This document is a draft prepared for review, written on 7 September 2026. It has not been reviewed by legal counsel, it contains placeholders that the operator must fill in before publication, and it is not in force. Nothing on this page has been agreed by you: the product does not yet ask anyone to accept it and keeps no record that anyone has. Read it as a statement of how the service is intended to be offered, not as a contract you have signed.
21 operator details on these pages are still unset and show as a marked blank. They are set as build-time environment variables - see client/.env.example.
Astro Clock AI is operated by [LEGAL ENTITY NAME], registered at [REGISTERED ADDRESS] (referred to below as we, us or the operator). These Terms of Use apply to the Astro Clock AI website and application, including the parts you can use without an account - the free calculators, the article pages, the convergence tool and any shared result link you open.
They set out the basis on which the service is offered. Where they refer to your data, they work alongside the Privacy Policy, which explains what is collected, where it goes and how to have it deleted. If you do not accept these terms, do not use the service.
There is no acceptance step yet, and no record that you saw this
What is not built. The signup flow does not link to this page. It does not link to the Privacy Policy. There is no tick box, no "by continuing you agree" line, and nothing on your account stores whether you saw either document, when, or which version. So we are not going to write the usual sentence saying that by creating an account you accepted this. You did not, and we have no record that says you did.
The step that fixes this is small and specific: a required, unticked confirmation at the final signup screen - I am 18 or older and I accept the Terms of Use and the Privacy Policy - with both documents linked from it, submission blocked until it is ticked, and the document version and timestamp stored against the account. Until that ships, these are published terms on which the service is offered rather than terms you have agreed to, and we will not argue otherwise.
The same missing step is the lawful-basis gap. India's Digital Personal Data Protection Act, 2023 has no legitimate-interest basis and no contractual-necessity basis. Processing is permitted on your consent, or on one of a short closed list of specified legitimate uses - and none of that list reaches a consumer astrology service. Consent is therefore the only basis available to us, consent under that Act has to be a clear affirmative action following a plain-language notice, and that flow does not exist in the product today. It is the single largest compliance gap on this page, we are not hiding it behind a form of words, and the Privacy Policy carries the fuller account.
You must be 18 or older
This service is offered only to individuals who have completed 18 years of age. You may not create an account, and you may not use the calculators or any other part of the service, if you are under 18. The reasons are not decorative:
- India's Digital Personal Data Protection Act, 2023 defines a child as anyone who has not completed 18 years, and will require verifiable parental or guardian consent before a child's personal data is processed at all. That requirement commences with the rest of the Act's substantive provisions, expected in 2027; we are applying the standard now rather than waiting for it. The Act sets no lower threshold - there is no 13 or 16 line as there is under some foreign laws.
- The same law places two absolute prohibitions on processing children's data that parental consent does not unlock: no processing likely to have a detrimental effect on a child's well-being, and no tracking, behavioural monitoring or targeted advertising directed at children. A service that generates predictive statements about a person's health, marriage, money and misfortune should not be pointing them at a minor.
- Separately, under the Indian Contract Act, 1872, a person below the age of majority cannot form a binding contract. Any paid plan sold to a minor would be unenforceable.
What is not built. We do not verify age at signup. There is no age check anywhere in the product - the only validation applied to a birth date, in the browser and on the server alike, is that it is not in the future - and there is no verifiable parental consent mechanism of the kind the Act will require. This is a condition you undertake, not one we enforce, and we are not going to describe it as a firm control while that is true. The gate belongs in the same validator that already parses the birth date, mirrored server-side so the browser is not the gate, and it is what we are building next. Note that the account holder's own age is a separate question from the birth date collected for charting, so the gate needs its own field rather than reusing that one.
If you are a parent or guardian and you believe a child has created an account, contact us at [SUPPORT EMAIL] and we will delete it and its data. If we learn on our own that an account belongs to someone under 18, we will delete it without waiting to be asked.
Note carefully that the birth details you enter are not necessarily your own - the service lets you build charts for a partner, a family member or a client. The 18+ requirement is about you, the account holder. Entering a child's birth details is separately governed by section 6 below.
2. What this service is, and what it is not
Astro Clock AI computes and interprets Vedic astrology charts, numerology numbers and traditional timing systems from a date, time and place of birth, and presents the result as readings, scores, timelines and written narrative. The arithmetic is real. Planetary positions are computed from standard published astronomical algorithms, and the divisional charts, dasha periods and numerological reductions are derived from those positions by documented traditional methods - all from your actual birth data, not assembled at random and not drawn from a bank of pre-written text.
Astrology and numerology are not science
Astrology and numerology are traditional interpretive systems. They are cultural and philosophical practices with a long documented history. They are not sciences, they are not supported by scientific evidence, and there is no accepted scientific mechanism by which planetary positions or the letters of a name determine events in a person's life. We are not going to dress this up. The calculations are performed accurately and honestly; what the calculations are held to mean is interpretation, not established fact.
Everything this service produces is offered for reflection, self-understanding, cultural interest and entertainment. It is a prompt for thinking about your own life, not a report on what your life is going to be.
This is not professional advice
Nothing produced by this service - no reading, chart, score, prediction, timing window, decision verdict, remedy, practice suggestion or AI chat reply - is:
- Medical advice. It is not a diagnosis, a prognosis, a treatment plan or a reason to start, stop or change any medication or therapy.
- Psychiatric or psychological advice. It is not mental health care, therapy, counselling or a crisis service.
- Legal advice. It is not an opinion on your rights, a case, a contract, a dispute or a court date.
- Financial or investment advice. It is not a recommendation to buy, sell or hold anything, and it is not advice on loans, property, business decisions or the timing of any transaction. We are not registered investment advisers.
- Relationship, marital, family, career, immigration, educational or fertility advice in any professional sense.
It is not a substitute for a qualified professional, and it must not be used as one. If a question in your life has a doctor, a lawyer, a financial adviser, a therapist or a registered practitioner who could answer it, ask them. Use this service alongside that advice if you find it useful. Never in place of it.
3. No guarantees about the future, and no health claims
We do not guarantee anything about your future
We make no promise, warranty or representation that any prediction, timing window, favourable period, compatibility score, decision verdict or forecast will be accurate, will come true, or bears any relationship to what actually happens. Language such as favourable, testing, strong, weak, yes, wait or no describes what a traditional system says about a chart. It does not describe the world, and it is not a statement of fact that can be relied on.
You remain solely responsible for every decision you make. If you choose a wedding date, a job, a business launch, a surgery date, an investment or the end of a relationship after reading something here, that is your decision and its consequences are yours.
No claims to cure, treat or prevent any disease
Nothing offered here - including any remedy, gemstone, colour, mantra, ritual, donation, fast, direction, daily practice or lifestyle suggestion - is claimed to diagnose, cure, treat, mitigate or prevent any disease, disorder or medical condition, to affect fertility or conception, to improve or restore any bodily or sexual function, or to alter the course of any illness. India's Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 prohibits advertising remedies as efficacious for the conditions listed in its Schedule, and we make no such claim in this product or anywhere else.
Where the service discusses health, it is describing what a traditional text associates with a chart placement. It is a cultural interpretation. It is not a finding about your body.
Do not delay real help
Never delay seeking, or disregard, medical, psychiatric, legal or financial help because of something you read here. If you have symptoms, see a doctor. If you are in a legal dispute, see a lawyer. If you are thinking about harming yourself or someone else, contact emergency services or a crisis helpline in your country immediately - this application is not a crisis service, nobody is reading your messages in real time, and it cannot help you.
We also do not describe these readings as guaranteed, proven or scientifically accurate - not in this product, not in our marketing, not anywhere. That is a forward commitment we hold ourselves to and audit before each launch, not a clause that claims to override a misleading statement made somewhere else. A disclaimer buried in a document you may never open cannot cure a claim you already read, and we are not going to pretend it can.
4. Your account and your birth details
Accuracy: garbage in, garbage out
You are responsible for the accuracy of the birth details you supply. This matters more here than in most products, and it is worth being specific about why.
- Time. The ascendant moves through the entire zodiac in roughly 24 hours - about one degree every four minutes. A birth time that is wrong by a few minutes can move the ascendant degree, and a time wrong by an hour or two can move it into a different sign entirely. Because the twelve houses are anchored to the ascendant, every house-based statement in your reading moves with it. A wrong minute is not a rounding error; it changes the answer.
- Place. The birth place is resolved to a latitude and longitude, and to a time offset - from a named timezone where the lookup returns one, and otherwise from a fixed offset held for that place. Where nothing resolves an offset at all the service falls back to Indian Standard Time. A wrong city, or the wrong one of two cities with the same name, silently corrupts the ascendant and the house positions in exactly the same way, and a fixed offset can be an hour out for a birth in a place that observed daylight saving at the time.
- Date. The date drives the planetary positions, the dasha timeline and every numerology number derived from it. There is no way for the service to detect that a correct-looking date is the wrong one.
If you do not know your birth time, leave it blank rather than guessing. The service will tell you which parts of the reading it cannot compute without it, which is more useful than a confident answer built on an invented time.
You can correct your birth date, time and place at any time from Settings. Doing so regenerates the derived reading so that a corrected chart does not sit behind a stale narrative.
One account per person
Each person may hold one account, registered to an email address they control. Do not create multiple accounts to work around a usage limit, and do not register an email address that is not yours. If you want to generate charts for other people, create additional profiles within your single account - that is what the profiles feature is for, subject to section 6.
Credentials, and what we can actually do if they leak
Keep your password to yourself. Do not share your login with anyone, do not let another person use your account, and do not use anyone else's. You are responsible for everything done through your account. Tell us at [SUPPORT EMAIL] immediately if you believe someone else has access to it.
What is not built. Be clear-eyed about what telling us achieves today, because section 13 places the loss from a compromised account on you and you should know what you are carrying. There is no password change and no password reset anywhere in the product. We cannot revoke a session that has already been issued - a signed-in session stays valid for up to 30 days, and nothing in the product invalidates it early, including account deletion. We do not limit failed login attempts: there is no lockout, no delay and no cap on guessing. In practice the only way to cut off access is to delete the account, which erases the readings and history in it. We are stating this rather than implying a support remedy that does not exist.
Two related limitations, for the same reason. The email address on an account cannot be changed after registration through any part of the service, and your name cannot be edited in the app either - we can change it for you on request, and it matters more than it looks, because several numerology numbers are computed from the letters of your name. Use an email address you will keep, and store your password somewhere safe. If you lose access to that mailbox, write to the grievance officer in section 16 before doing anything else - see section 16 for what we can accept instead.
Messages
The service includes an optional daily message channel that requires you to give a phone number and tick an explicit consent box. It is off unless you turn it on, and you can turn it off at any time from the same page - the message settings page is the one control for both. Turning it off deletes the stored number and keeps only a consent record carrying the last four digits, as proof of what you agreed to and when; that record is itself deleted if you delete your account.
No messaging provider is connected today, so nothing is actually being sent to any phone - the only delivery path that ships records what would have been sent and contacts nothing. If we connect a provider, we will name it in the Privacy Policy before the first message goes out, and the consent you gave, the wording you agreed to and the hours you chose all continue to apply.
5. Acceptable use
You may use the service for your own purposes, including in your professional practice - the profiles feature exists partly so that a practising astrologer can hold client charts, and section 6 governs the consent you need to do that. What you may not do is pass the output off as something it is not, or turn the product into a supply of raw material for your own. Specifically, you may not:
- Scrape, crawl or harvest any part of the service, or use any bot, spider, headless browser, script or other automated means to access it, extract its content or enumerate its pages or share links.
- Call our endpoints from your own software. We do not offer or licence an API for programmatic use, and you may not build a client, integration, wrapper or derived product on top of one. Some endpoints are reachable without an account because the free calculators, the convergence tool and shared links have to work without one - that is a consequence of those features, not an invitation, and no licence to call them is granted.
- Pass readings off as your own work. You may not present output from this product as your own professional work, as the work of a human astrologer, or as a product of your own - whether for money or not - and you may not resell or republish it at scale.
- Attempt to defeat usage limits. Share-link caps and request rate limits are enforced today; daily reply caps and question quotas apply whenever paid tiers are in effect, and are not in effect while every feature is free. Do not create extra accounts, rotate addresses, replay requests or otherwise work around any limit we apply.
- Attack or probe the service. No penetration testing without written permission, no attempt to access another account or another person's data, no interference with the infrastructure, no uploading of malicious code, and no attempt to circumvent authentication.
- Misuse the free text fields. Do not submit unlawful, abusive, defamatory or obscene content, content that infringes anyone's rights, or content designed to manipulate the AI into producing prohibited output.
- Use the service to make decisions about other people in a way that affects their rights or livelihood - for example screening job candidates, tenants, borrowers, employees or prospective spouses on the basis of a chart. This is not what the product is for and we do not sanction it.
- Remove or obscure attribution on a shared result card, or alter it to misrepresent what it says.
We may impose or change usage limits at any time, and we may take technical measures to enforce this section.
6. Birth details belonging to other people
The service lets you save profiles for a partner, a family member, a client or anyone else, each holding a full birth record, and it generates and stores an AI-written reading about that person. Their computed chart is also what gets sent to a third-party model provider when you ask a question about their profile - see section 7, which applies to them exactly as it applies to you. Those people are not our users. They did not agree to these terms and they have no account.
What is not built. The product does not give those people an account, a notification or a screen through which to see, correct or delete what you entered about them - they have no way even to discover that a record exists. That is a description of the product's current limitations, not of their legal position. They remain the people the data is about, they keep their rights over it against us under India's data protection law, and section 16 is how they reach us. We handle such a request by hand against the database, because there is no operator tool for it.
So, plainly: only enter another person's birth details if you have their permission to do so. By entering them you confirm that you have that permission, that you have told them what the details are being used for, and that you will delete the profile if they ask you to. Do not enter details you obtained without the person's knowledge.
Do not enter details for a child. And be aware that we do not stop you: the profile form applies the same single check the signup form does, that a birth date is not in the future, and nothing refuses a profile whose date implies the subject is a minor. In an India-first product a parent building a child's kundali is an ordinary thing to want, so this is not a hypothetical gap - it is a real one, the same date check belongs on the profile form as on signup, and until it ships the prohibition is a request rather than a control.
Your undertaking does not move our own duty. India's data protection law makes the operator responsible for what it processes regardless of any agreement to the contrary and regardless of whether a user kept their side. Asking you to confirm permission is how we set the expectation between us; it does not transfer our obligations to you, and we are not claiming that it does.
You are responsible for the profiles you create. If someone asks us to remove a profile about them, write to [SUPPORT EMAIL] with enough detail to identify the record and we will act on that request - which may mean deleting the profile from your account without further notice to you. Two honest caveats. We have no way to contact the people whose details you enter, so this depends on them finding out some other way. And deleting a profile does not today remove the life events or practice records logged against it; we remove those by hand on request, and closing that gap is on the same list as the rest.
7. AI-generated content
Part of what you read in this product is written by a large language model. It is worth understanding exactly what that means here, because it is narrower than most people assume and it fails in specific ways.
What the model does
The astrological and numerological calculation is not done by the AI. It is done by this product's own deterministic engines from your birth data. The computed result - your chart placements, dasha lords, detected yogas, numerology numbers, timing signals - is then handed to a language model, along with your question and your recent conversation, and the model is asked to put it into readable prose. The model is a writer working from a brief. It is not an oracle and it is not the source of the astrology.
The narrative you receive is generated from your own chart data. It is not retrieved from a library of pre-written readings, which is why two people with different birth details get genuinely different text, and why the same question asked twice may not produce identical wording.
It can be wrong
- Language models produce fluent text that can be factually incorrect. Confidence in the writing is not evidence that the content is right.
- The model can misread or misattribute a computed value, invent a detail that is not in your chart, or contradict something it said earlier in the same conversation.
- Output is not consistent. Asking the same thing twice can produce different answers, and neither one is authoritative.
- It has no knowledge of your actual circumstances beyond what you have typed and what your chart computes to. It cannot know your health, your finances or your relationships.
Do not treat AI-generated output as fact. Treat it as one interpretation of a traditional system, written by software, to be weighed with your own judgement and with advice from people qualified to give it. Everything in sections 2 and 3 applies to AI output in full.
Where the text is generated, and what leaves the country
The written narrative is produced by a third-party language-model provider - currently Groq, Inc. or Anthropic, PBC, depending on which is configured - whose servers are outside India. Your question, your recent conversation, life events you logged, and the computed chart data of whichever profile the question is about - which may be another person's, if you asked about a profile you created for them - are transmitted there so the reply can be written. This is a cross-border transfer of personal data and we are naming it as one.
Your name, your email address, and the birth date, time, place and coordinates as you typed them are not sent. We want to be careful about how much comfort you take from that, because the precision of what is sent undercuts it: the Moon, Sun and ascendant positions travel as sidereal longitudes to four decimal places, alongside dasha lords and numbers reduced directly from the date of birth. An ascendant longitude at that precision is a function of the exact birth instant and the birth coordinates. The labels are withheld; the birth moment and place are substantially recoverable from the values. Treat this as your birth data leaving the country in derived form.
What those providers retain, for how long, and whether they train on it is governed by their terms, not by ours, and nothing in this product asks them to delete anything. Text already sent cannot be recalled - not by you, and not by us. When no provider is configured, the product falls back to its own built-in engine and nothing leaves our server. The Privacy Policy carries the fuller account.
This does not only happen when you ask a question. A full written reading is generated automatically the moment you create an account, and again whenever you correct your birth details or create or edit a profile for someone else. Your chart data is sent to the provider at that point without any further action from you, before you have opened the chat and before you have read this. There is no consent gate in front of it, no notice at the moment it happens, and no setting anywhere in the product that turns AI text generation off while keeping the account. If you do not want this processing, the only options today are not to create an account, or to delete it.
8. Pricing and payment
The service is currently provided free of charge. Every account presently receives the full feature set at no cost. We do not collect payment details, we do not process payments, and no payment provider is connected to this product today. There is nothing to cancel and nothing to be refunded.
While the service is free, plan prices are hidden throughout the interface and the only figure shown anywhere is a zero. If priced tiers become visible again, those figures are indicative of plans that are not yet live: they are not an offer, and no charge arises from them. Should that happen, the label saying so belongs next to the price at the point it is displayed and not only in this clause - a qualification a reader has to leave the page to find is not a qualification.
We may introduce paid plans in future. If we do, we will give you notice in advance, and no charge will ever be made without your explicit agreement to the price and the billing terms at that time. Separate payment, billing, cancellation and refund terms will be published before any payment is taken, and this section will be replaced. Nothing here commits you to a future payment, and continuing to use a free service is not agreement to a future price.
Because the service is free, we may change, limit or withdraw any feature at any time, as set out in section 9.
9. Availability, and the service is provided as-is
We do not promise that the service will be available at any particular time or to any particular standard. There is no uptime commitment and no service level agreement. The service may be unavailable for maintenance, for deployment, because of a fault, because of a failure at a hosting, database or model provider we depend on, or for reasons outside our control.
We may add, change, restrict or remove features, limits and content at any time, and we may discontinue the service entirely. Where we discontinue it, we will try to give reasonable notice so that you can retrieve anything you want to keep, but we cannot guarantee notice in every circumstance.
The service is provided on an as-is and as-available basis. To the fullest extent permitted by law, we exclude all warranties, conditions and representations of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not warrant that any interpretation, reading or AI-generated text is accurate, complete, reliable or suitable for any purpose - that is a disclaimer about what a traditional system is taken to mean, and it is deliberately not a disclaimer of the arithmetic, which section 2 says we perform accurately and which we stand behind. This exclusion is subject to section 13, and nothing in it removes any right you have as a consumer under Indian law.
You are responsible for keeping your own copies of anything you want to preserve. We are not a backup service and we do not guarantee that stored readings, conversations or logs will remain available.
What is not built. That last paragraph asks you to keep your own copies, so it has to say what you can keep them with, which is not much. There is no export or download of your data anywhere in the product - no archive, no portable copy, nothing an access request can be served from automatically. Your chat history is only ever shown 100 messages at a time, and the product keeps more of it than it will display back to you. If you want a copy of what we hold, write to [SUPPORT EMAIL] and we will assemble it by hand. An export endpoint is what should exist instead, and it is on the list.
10. Intellectual property
What is ours
The software, calculation engines, interface design, layout, illustrations, written editorial content, article pages, product copy, the Astro Clock AI name and the associated branding are owned by the operator or licensed to it, and are protected by copyright and other intellectual property laws. Nothing in these terms transfers any of that to you. You get a personal, limited, non-exclusive, non-transferable, revocable licence to use the service as it is offered, and nothing more. You may not copy, modify, adapt, decompile, reverse-engineer or create derivative works from any part of it, except to the extent that such acts are expressly permitted by section 52 of the Copyright Act, 1957 and cannot lawfully be restricted by agreement.
The underlying traditional systems - Vedic astrology, numerology, the classical texts these methods come from - are not owned by anyone. Our implementation and expression of them is.
What is yours
Your birth details, your name, the questions you type, the life events you log and the notes you write remain yours. You grant us a licence to store and process them, and to transmit the parts described in section 7 to a model provider, solely for the purpose of operating the service and producing your readings. That licence exists to run the product and for no other purpose. We do not sell your data, and we do not use it to advertise to you.
Two specific secondary uses you should know about, because "producing your readings" does not obviously cover either. The coordinates of your birth place are reused as a stand-in for where you are now when a question chart is cast - we do not ask for your current location, so your birth place is what the calculation has. And the time offset of your birth place is reused as your assumed present-day timezone, to work out your local hours for message timing. Both are engineering compromises rather than choices about you, and neither is declared anywhere else in the product, which is why they are declared here.
The readings, charts and narrative generated for you from your own data are yours to read, keep, print and share personally. What you may not do is republish them at scale, or present them as a commercial product or as your own professional work - see section 5.
12. Suspension, termination, and your right to delete
Your right to leave
You can delete your account at any time from Settings. You do not need to ask us, give a reason or wait for approval. Deletion is permanent and cannot be undone. You can also stop using the service at any time without deleting the account.
Deleting the account erases every collection that holds data for it: your account record, your profiles and the readings generated about them, your chat history, the life events you logged, your practice records, the questions you asked, your share links, your message settings and message history, and your messaging consent record. The Privacy Policy sets out what sits in each of those.
Three limits on that, stated so "permanent" is not read as more than it is. A session token issued before deletion is not revoked and may remain valid for up to 30 days. Text already sent to a model provider under section 7 cannot be recalled by deleting your account - nothing in the product asks the provider to delete it. And what happens to a deleted row in the database provider's own backups is a property of that hosting arrangement rather than of this software; the Privacy Policy says what is known about it.
Nominating someone to act for you
India's Digital Personal Data Protection Act, 2023 lets you nominate one or more individuals to exercise your rights under that Act on your behalf if you die, or if you become unable to exercise them yourself through unsoundness of mind or infirmity of body. The Rules made under the Act route that nomination through a service's terms of use, which is why it is set out here rather than in the Privacy Policy. It matters more for this product than for most: a stored written reading, a logged history of life events and a birth record are exactly the material a family asks about afterwards.
To nominate someone, write to the grievance officer in section 16 from the email address registered on your account, giving:
- the email address registered on your account, which is how we identify it;
- the nominee's full name, their relationship to you, and an email address and phone number at which we can reach them.
We will confirm the nomination by reply and keep it on file. You can change or withdraw it the same way, at any time, and the most recent instruction from your registered address is the one that stands. Once invoked, the nominee may ask us for a summary of the data we hold about you, ask us to correct it, or ask us to erase it and close the account. Before we act on any of that we will ask the nominee for evidence of your death or incapacity - a death certificate, or a medical certificate or court order - and for proof of their own identity. We will not act on an unverified request, because acting on a false one would be the worse error.
What this is, exactly. A documented email route, staffed by a person. There is no nomination field in the product and no screen to enter one; the Rules require the route to be published in the terms of use rather than built into a screen, and this is that route.
Our right to suspend
We may suspend or terminate your access, by whatever means are available to us and with or without notice, if we reasonably believe you have breached these terms - in particular section 5 or section 6 - if your use threatens the security, integrity or availability of the service or the data of other people, or if we are required to do so by law. There is no suspension flag in the product today and no operator console: in practice we would have to act directly against the database, and we would rather say that than imply a moderation system that does not exist.
Where it is practical and lawful to do so we will tell you why and give you a chance to respond, but we may act first where the risk is immediate. Read that alongside section 15: we have no way to send you an email from the product, so "tell you" means a reply from the grievance officer's mailbox if you write to us, or a notice on this page.
We may also terminate access generally if we discontinue the service.
Sections 2, 3, 5, 6, 10, 11, 13, 14 and 16 survive termination, along with any other clause that by its nature should. Section 11 is on that list because a share link you created can outlive the account by up to 90 days and the permission to host it has to outlive it too; section 16 is on it because a former user still needs a route to complain, and a dispute about erasure is exactly the kind that arises after the account is gone.
13. Limitation of liability and indemnity
This section limits what we are responsible for. Read it.
To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of the service or from any decision you take in reliance on anything it produces. That includes, without limitation, financial loss, lost profits, lost opportunity, business loss, loss of data, loss or damage to a relationship, marital or family consequences, distress, or any harm arising because you acted on a reading, a prediction, a timing window, a decision verdict, a remedy or an AI-generated reply - or because you delayed or did not seek medical, psychiatric, legal or financial advice.
We are also not liable for loss arising from the service being unavailable, from an error or inconsistency in a calculation or a generated text, from a failure at a hosting, database or model provider, from anything a person does with a share link you published, or from anyone else's use of your account where you did not keep your credentials safe - subject, on that last point, to what section 4 says about the recovery tools we do not have.
Financial cap. Where liability cannot be excluded, our total aggregate liability to you for all claims is limited to the total amount you have actually paid us for the service in the twelve months before the claim arose. The service is currently free of charge, so that amount is presently zero. We are stating that plainly rather than hiding it in a formula. If paid plans are introduced, the cap will be the amount actually paid.
What we do not limit. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under Indian law. Your rights as a consumer under the Consumer Protection Act, 2019 and your rights under the Digital Personal Data Protection Act, 2023 are not affected by anything in this document. If any part of this section is held unenforceable, the rest continues to apply.
Indemnity. You agree to indemnify us against any claim, demand, loss, liability or reasonable legal cost brought by a third party and arising from your deliberate or reckless breach of these terms, from your fraud, or from your deliberate or reckless misuse of the service - including supplying birth details or other personal data about another person that you knew, or were reckless as to whether, you had no right to supply. It does not run to an ordinary or inadvertent breach. Your total liability under this indemnity is capped at [INDEMNITY CAP IN RUPEES]. We will tell you promptly about any such claim, will not settle it without consulting you, and will let you take part in the defence.
This indemnity does not apply to, and does not reduce, our own obligations as the operator under the Digital Personal Data Protection Act, 2023, which remain ours irrespective of this or any other agreement. It is deliberately narrower and capped: an uncapped indemnity running from an individual to the operator of a free service, sitting three paragraphs below a liability cap of zero, is the kind of one-sided term a consumer forum sets aside, and a clause that gets struck says more about the document than the clause.
14. Governing law and jurisdiction
These terms, and any dispute or claim arising out of them or out of your use of the service - including non-contractual disputes - are governed by the laws of India.
The courts at [JURISDICTION CITY], India shall have exclusive jurisdiction, subject to any right you have as a consumer under Indian law to bring proceedings before a consumer forum where you reside. Nothing in this clause takes away a right of that kind.
Before starting proceedings, please raise the matter with us using section 16 so that we have a chance to resolve it.
15. Changes to these terms, and language
We may update these terms as the product changes or as the law requires. When we do, we will change the effective date shown at the top of this page and post a notice in the application.
What is not built. We cannot email you. There is no transactional email capability anywhere in this product - no mail service, no provider, nothing - and no in-app announcement or notification mechanism either. So the promise most terms pages make here, that you will be told individually before a material change takes effect, is one we cannot keep today, and we are not making it. Please check this page. Building at least one working channel is a precondition for the paid plans section 8 describes, because a price change with no way to warn anyone is not a change we should be able to make.
Continuing to use the service after a change takes effect means you accept the updated terms. If you do not accept them, delete your account. That is a weak basis for a change that materially affects your rights - a new charge, a significant new restriction, a change to the liability section - and it is weaker still while there is no acceptance step at all. Once the confirmation described in section 1 exists, a material change should require you to accept it again at your next sign-in rather than be inferred from your silence, and acceptance by continued use should be left to changes that do not affect your rights.
Language. The application is available in Hinglish, English and हिंदी. This document is published in English only, deliberately: legal text whose meaning drifts between three translations is a risk to you as much as to us. The English version of these terms governs. If we publish a translation for convenience and it conflicts with the English, the English text prevails. If any part of these terms is held invalid or unenforceable, the remaining parts continue in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the whole agreement between us about the service.
16. Contact and complaints
For questions about these terms, or about anything in the service:
- Operator
- [LEGAL ENTITY NAME]
- Registered address
- [REGISTERED ADDRESS]Add every branch or additional place of business here as well, not only the registered office.
- Customer care email
- [SUPPORT EMAIL]
- Customer care phone
- [CUSTOMER CARE PHONE - LANDLINE AND MOBILE]
- Grievance officer
- [GRIEVANCE OFFICER NAME][GRIEVANCE OFFICER DESIGNATION][GRIEVANCE OFFICER EMAIL][GRIEVANCE OFFICER PHONE]
That one named person is our grievance officer under the Consumer Protection (E-Commerce) Rules, 2020 and under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and is also the person able to answer questions about the processing of your personal data under the Digital Personal Data Protection Act, 2023. One contact covering all three is deliberate, and worth saying out loud so nobody has to guess which address to write to.
A note on which law applies today, because this document names the DPDP Act several times. That Act's substantive provisions have not commenced - they are expected in 2027 - and until they do, personal data in India is handled under the Information Technology Act, 2000 and the 2011 Rules made under it. The officer above is the designated grievance officer under those Rules. We describe the DPDP standard in this document because it is the standard we intend to meet, and we have tried to say clearly, each time, which parts of it we already meet and which we do not.
Making a complaint
If you have a complaint, write to the grievance officer above. We will acknowledge it within 48 hours of receiving it and resolve it within one month, as required by Rule 4(5) of the Consumer Protection (E-Commerce) Rules, 2020 and Rule 5(9) of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. Our own internal target is 30 days, which is tighter than either rule requires; the binding commitment is the one month above.
Include the email address registered on your account. That address is the particular we use to identify you - for a complaint, and equally for any request to exercise your rights over your personal data, including access, correction, erasure and withdrawal of consent. The same mailbox handles both; the Privacy Policy sets out what happens to a data request once it arrives, and names the same contact.
If you have lost access to that mailbox, write to the grievance officer anyway and tell us so. We will ask you for other information to verify the account instead - we are not going to treat a lost password as a reason you cannot exercise a right, and we are not going to make deleting your own data the price of losing an inbox. This matters here more than it would elsewhere, because as section 4 says there is no password reset and the registered address cannot be changed, so a right that only a working mailbox can exercise would be no right at all.
What is not built. Acknowledgement means a reply from that mailbox, sent by a person. There is no ticketing system, no complaint form in the product, no automatic acknowledgement, and no access or audit log to investigate a complaint against. The commitment above is a commitment by the operator, staffed manually, and it is worth nothing unless the mailbox in the table is genuinely monitored - which is the operator's obligation before this page is published, not a detail to settle afterwards.
